Therefore, the minutes were deemed adequate and approved for posting. PSD Workgroup Update Dave Klemp updated the conference call participants on the activities of the PSD Workgroup. The Workgroups last conference call took place at the end of October 2002. The Workgroup is pursuing the following two items. See  HYPERLINK http://www.westar.org\\psd www.westar.org\psd for further information and/or contact Dave Klemp. Draft guidance document on the redesignation issues. Increment tracking. The Technical Committee (Mary Uhl) is taking the lead on this topic. A workshop will be held March 25-27, 2003 in Albuquerque, NM. Three additional work items arose as a result of the meeting on FLAG held November 7, 2002 in Denver, CO. The summary notes and minutes from the FLAG meeting are posted on the WESTAR website with the other PSD related postings. Clarify the statutory/regulatory responsibilities of state permitting agencies and permit applicants regarding cumulative [AQRV] impact analysis. Identify alternative approaches, and recommend one or more preferred approaches, for states to track increment consumption. (Same as 2 above.) Identify alternatives available to a state when it has been determined that an increment has been exceeded, or that there will be an adverse impact to an AQRV. The next conference call has not yet been scheduled but will probably occur after a draft of the guidance document is ready for review. The PSD Workgroup will continue to provide monthly updates to the Sources Committee via conference call. The PSD Workgroup is seeking volunteers to work on items A and C. Volunteers should contact Dan Johnson or Dave Klemp. Flash Emissions from Oil/Gas Development WESTAR states have expressed concern about flash emissions from oil/gas development and there was an EPA Region VIII meeting on this topic within the last month. An e-mail was sent out to gauge the level of interest in forming a workgroup. The workgroup would be a joint subgroup of the Technical and Sources Committees with the Technical Committee addressing the emissions inventory side of things. Informal replies of interest have been expressed by the states of NM, WY, CO, UT, MT and possibly KS and AK. There is concern that in EPA Region VIII the lead on this topic has been taken by the enforcement staff. The hope is that the enforcement staff will handoff the topic to the air program technical staff. EPA Region VIII apparently has no written game plan. However, it is believed that 114 requests may be submitted by the EPA Region VIII compliance staff to some of these sources. It would be nice to use the WESTAR clout or multi-state clout to influence the process more regarding whom is addressing this issue at EPA (enforcement staff or technical staff). In addition the desire if for the states to be more in charge of the process and compliance rather than the EPA regions. A letter from Dan Johnson to EPA Region VIII expressing an interest in a consolidated effort and an invitation to participate in the education effort is necessary. A workgroup will be established and the issues and interests regarding emissions levels, controls etc. will be explored. At the present time it is probably more of an educational thing amongst states. Rick Sprott will get back to Dan Johnson after speaking with Martin Hestmark, EPA Region VIII, regarding their plans on this topic. Bob Lebens will follow-up on the workgroup establishment with Mike Silverstein and Mary Uhl. Backstop Emissions Trading Program for Regional Haze Bob Lebens gave the conference call participants an overview regarding activity associated with the backstop emissions trading program for regional haze. The backstop emissions trading program is triggered when the milestones are exceeded. In a 6-month effort a WESTAR workgroup has been reviewing and updating the model rule and MOU that accompanied the Annex. The work has focused on developing SIP text and a separate rule for subject sources. The rule must be in place via a SIP by December 31, 2003. The workgroup has completed a redraft that is under review and informal comment. The redraft will be revised at the end of this year. Some questions were sent back to the WRAP Market Trading Forum on applicability issues. There has been additional indirect involvement via workgroup members (UT, AZ, NM, WY). The workgroup is still seeking feedback on compliance certification authorities beyond Title V sources. Anyone that wants a more detailed look at what is going on should contact Bob Lebens. WESTAR Committee Meeting The annual get-together for the WESTAR Committees has been scheduled for February 19-20, 2003 in Portland, OR. The main objectives of the meeting are to discuss accomplishments and planning. There is funding in the budget to help fund travel costs to attend the meeting. As Rick Sprott will be unable to attend the meeting, Dan Johnson asked him to relay his input on priority items to the Sources Committee on the next conference call. Other Business Applicability Determination Index (Mike Schneider, NM) Mike brought up a recent (November 13, 2002) ADI ruling for Detroit Edison and was interested in Committee members thoughts regarding the interpretation that certain postings to the ADI cannot be used as precedent that companies nationwide must follow.
